By accessing or using Apex Fund Trader's services, website, or trading platform (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use our Services.

These Terms constitute a legally binding agreement between you and Apex Fund Trader. We reserve the right to modify these Terms at any time, and your continued use of our Services constitutes acceptance of any changes.

2. Eligibility Requirements

3. Trading Challenges and Programs

Apex Fund Trader offers various trading challenges and funding programs. By participating in these programs, you acknowledge and agree to the following:

• Each challenge has specific trading rules, profit targets, and maximum loss limits that must be followed
• Failure to comply with challenge rules may result in disqualification without refund
• Successful completion of a challenge does not guarantee funding or continued participation in subsequent programs
• All trading is conducted on simulated accounts unless explicitly stated otherwise
• We reserve the right to modify challenge rules, requirements, and offerings at any time

4. Trade Now Pay Later (TNPL) Program

Our Trade Now Pay Later program allows traders to start challenges with a reduced upfront payment. By participating in TNPL, you agree to:

• Pay the initial deposit as specified for your chosen challenge size
• Pay the remaining balance upon successful completion of all evaluation phases before receiving funded account access
• Understand that failure to complete phases means forfeiture of the initial deposit
• Accept that TNPL terms and pricing may change for future challenges

5. Payment Terms

All payments for Services are subject to the following terms:

• All fees are stated in USD unless otherwise specified
• Payments are non-refundable except as expressly stated in our Refund Policy
• You are responsible for all applicable taxes, duties, and fees related to your purchase
• We reserve the right to change pricing at any time with or without notice
• Payment processing is handled by secure third-party payment providers

6. Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Ensuring all information provided to us is accurate and up-to-date
• Complying with all applicable laws and regulations in your jurisdiction

7. Prohibited Activities

When using our Services, you agree not to:

• Engage in any fraudulent, abusive, or illegal activities
• Use automated trading systems, bots, or algorithmic trading without prior written approval
• Manipulate markets, prices, or exploit platform vulnerabilities
• Share, sell, or transfer your account access to any third party including family or friends
• Violate any trading rules, guidelines, or restrictions specified in your challenge
• Use our Services in any manner that could damage, disable, or impair our platform
• Attempt to gain unauthorized access to any portion of our Services or systems

8. Intellectual Property

All content, trademarks, logos, and intellectual property on our platform are owned by Apex Fund Trader or our licensors. You may not:

• Copy, modify, distribute, or reproduce any content without our written permission
• Use our trademarks, logos, or branding in any manner without authorization
• Reverse engineer, decompile, or disassemble any aspect of our platform
• Create derivative works based on our Services or content

9. Disclaimers and Limitations

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability, fitness for a particular purpose, and non-infringement
• Accuracy, reliability, or completeness of any content or information
• Uninterrupted, secure, or error-free operation of our Services
• Any results or outcomes from using our Services

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICES.

10. Indemnification

You agree to indemnify, defend, and hold harmless Apex Fund Trader, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of our Services, violation of these Terms, or infringement of any third-party rights.

11. Termination

• Violation of these Terms or any applicable laws
• Fraudulent, abusive, or harmful behavior
• Non-payment of fees or chargebacks
• Extended periods of inactivity

Upon termination, your right to use our Services will immediately cease, and we may delete your account and all associated data.

12. Dispute Resolution

Any disputes arising from these Terms or your use of our Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class action lawsuits or class-wide arbitration.
